City Staff has decided to withdraw their original proposal to convert all 12 Planned Unit Developments (PUDs) in the Selva Marina and Selva Tierra neigborhoods to Residential Single Family 1 (RS-1). After consideration of the home owners who were not in favor of this rezoning, staff will seek other ways to resolve the administrative problems in this area. The difficulties are that none of the PUDs have governing boards (Home Owners Associations) which is required to keep their active status as legal Planned Unit Developments. If a PUD hasn't been active after 30 years, legally they are no longer bound by their previous covenants. In such a case, these areas could be considered to have no building restrictions at all.
There will be a Commission Workshop on Monday, August 20th in City Chambers at 5pm to discuss this rezoning issue as well as other projects.
The Community Development Board will also meet on Tuesday, August 21st in City Chambers at 6pm. The purpose of this meeting was to review the rezoning ordinance. Since the ordinance has been withdrawn, there will be a discussion on what the staff and the CDB believe should be the next steps going forward.
